Making a Structural Engineer Negligence Claim
Where the negligence of a structural engineer has resulted in structural failure, expensive remedial works or significant delay, a report will usually be required from an independent structural engineer. The expert evidence of the independent structural engineer will be crucial in determining liability and establishing engineers negligence.
Expert reports can be carried out on a “joint” basis. This is where both parties to the dispute (the solicitors making the professional negligence claim and the lawyers defending the negligent structural engineer) get together and agree to instruct one expert to undertake a report. It is more common however for each side to obtain its own report. Experts can very often disagree so it is vitally important that the correct expert is selected. Our experience in dealing with professional negligence claims enables us to ensure that we choose the right expert witness who is fully qualified to comment authoritatively on the losses in dispute. It is also important to choose experts who are experienced themselves in acting as expert witnesses in structural engineering professional negligence cases and know how to set out a report for use in court and, if it comes to it, give evidence in person.
