Time limits and dental negligence claims
Dental negligence claims differ from other professional negligence claims in that they are classified as personal injury cases. So, along with medical negligence, dental negligence claims have a limitation period of three years rather than the usual six years. This means that if court proceedings are not commenced within three years of the date on which the dentist was negligent then the claim is likely to be out of time, unless the patient was a child.
The exception is where the patient is not aware that the dentist has been negligent and only discovers this at a later date. In these circumstances, the court will allow the three year period to run from the patient’s “date of knowledge”.
In our experience, it is best not to take any chances with a dental negligence claim and we recommend that injured patients seek legal advice from a solicitor specialising in dental negligence claims at the earliest possible stage.
No Win – No Fee Dental Negligence Claim
Many people are put off by the fear of legal costs. However if you feel your dentist has been negligent you can simply call our free legal helpline. If we think you have a good claim then we will deal with it on a No Win – No Fee basis without the need for any fees to be paid up front.
If necessary we will obtain an ‘expert’s report’ from an independent dentist who is experienced in giving evidence in dental negligence cases. Hopefully the case we put together will be sufficiently strong to persuade the insurers of the negligent dentist settle out of court. It is only if a negotiated settlement cannot be reached that court proceedings will have to be commenced.
Dental Negligence Compensation
If your claim is successful you will be entitled to receive compensation for all losses arising directly from the dental negligence, including:
- Your ‘pain and suffering’
- The cost of dental/medical treatment
- Any lost earnings
- Other out of pocket expenses
